When and how to make an appeal to the Appeals Board on Visa Refusals? ?

La Commission de Recours contre les Refus de Visa (CRRV) est une commission de recours amiable, qui dépend du Ministère de l’Intérieur, et dont le but est de traiter les recours contre les décisions de refus de visaThe purpose of the Appeals Board against the refusal of Visa, under the Ministry of the Interior, is to process amicable appeals against visa refusal decisions.

An appeal to this commission must be written in French, and forwarded to the Appeals Board within 2 months: :

  • from the notification of the negative decision, for an express refusal; ;
  • from the end of 2-month period without response, for an implicit refusal.
  • Le recours formulé auprès de cette commission doit être argumente et étayé des pièces justificatives qui seront utiles à la décision contestée. En cas d’urgence , ce recours peut être doublé d'une requête en référé devant le Tribunal Administratif , si la décision de refus de visa est manifestement illégale.

    The Appeals Board is asked for an opinion and has no binding force, i.e. it cannot impose any decision. It can :

  • Give a favorable opinion to the appeal and recommend the Ministry should grant the visa - the latter makes the final decision, without necessarily following the recommendation of the Appeals Board.
  • Dismiss the appeal, either by a refusal letter or by an implicit refusal, at the end of a 2-month period.
  • In the majority of cases, appeals to the Appeals Board are unfortunately rejected. You can still make an appeal to the Administrative Court of Nantes. Indeed, while 10% of appeals to the Appeals Board have a positive outcome, it is the case of 40% of appeals made to the Administrative Court. Note that it is necessary to first go through the Appeals Board.
